New UKBA marriage visa fees come into effect on 6 April 2013


The UK Border Agency (UKBA) recently announced another annual fee increase, set to come into force on 6 April 2013. The processing fee increase will affect UK fiancee, partner and spouse visa applications made under the settlement category through British Embassies, Consulates and High Commissions overseas as well as extension (further leave to remain and indefinite leave to remain) applications made from inside the UK.

Applicants making a UK settlement visa application from outside the UK will see that the UKBA processing fee has risen by £25 to £851 – the list includes UK marriage (spousal) visa applications; engaged couples (fiancee visa); civil partnerships and the unmarried partner visa, which is also sometimes referred to as a de facto partner visa. Applications made and paid for before 6 April 2013 will not be subject to any additional fees.

Applications made from inside the UK, including postal and premium (in person) Further Leave to Remain (FLRm) and Indefinite Leave to Remain (ILR) applications will be in line with the annual 3% fee increase. Postal FLRm and ILR applications for partners and spouses of British citizens and permanent residents with no dependents will now cost £578 and £1051, respectively. Things are rather more difficult to understand when it comes to prices for in-person premium FLRm and ILR applications at local UK Border Agency public enquiry offices (PEO). There is now an additional charge of £375 on top of the application fee, which is made up of two elements, one of which is a strictly non-refundable appointment booking fee in the amount of £100 per applicant.

In other news, it is expected later this year that the UK Border Agency will implement a small £55 processing fee for applications made by non-EEA family members of EEA nationals living and working in the UK. These include in-country applications for a 5 year residence card for spouses and partners of eligible EEA nationals who wish to confirm their right to live and work in the UK.
